Many people think that an estate plan is not necessary because they “do not have enough assets” or “don’t have a large estate.” This common misconception can have long lasting negative consequences in many situations. If there are no legal documents in place, Tennessee law will apply and a Judge will make a determination regarding: the appointment of a guardian for your children; the appointment of a guardian in the event you are incapacitated; the determination of your heirs under Tennessee intestacy laws which will determine how your assets are distributed.
